Sections 106 and 110 of the National Historic Preservation Act (NHPA), NEPA, and other federal and state cultural resource protection statutes govern development regulations. The purpose of these laws is to protect historic and archaeological sites.

Specifically, Section 106 of NHPA requires Federal agencies, or entities using federal funds, to take into account the effect of their undertakings on properties included or eligible for inclusion in the National Register of Historic Places, and to allow the Advisory Council on Historic Preservation a reasonable opportunity to comment on such undertakings. The goal of the consultation process is to identify historic properties that could be potentially affected by the undertaking, assess the undertaking effects and identify means to avoid, minimize, or mitigate any adverse effects to historic properties.

If a project involves federal funding, federal action or federal approval, the project actions must go through the “NEPA process”. NEPA legislation established a national policy for the environment and requires federal agencies, in cooperation with state and local governments, to consider the potential environmental effects of their activities, one of which is potential impacts to historic resources.
Additionally, Federal law and regulations protect fossils (paleontology) on Federally-owned lands and inventories may be required for projects located on Federal lands. In the State of Colorado, the Historical, Prehistorical, and Archaeological Resources Act also protects all fossils on state-owned lands and lands controlled by any subdivision of state government.
